Legal Question in Insurance Law in New York

Car Title/Car Insurance

My boyfriend helped his last girlfriend get a car to get back and forth to nursing school with-- the title and insurance is still in his name though she pays him monthly supposedly. I want him to get this taken out of his name and he's tried to get her to do this but she does not have the credit apparently, which is why he put it in his name in the first place. What can he legally do to get his name off of the title/insurance? What are his rights legally? What could go wrong if he doesn't get this car out of his name?

Thank You.

Re: Car Title/Car Insurance

The car is in his name, he owns it, he can sell it or surrender it back to the finance company (though that would be a derogatory credit event, but maybe not as derog as lots of late payments). He needs to have the title certificate (he should have the car re-titled if she has the title certificate) and a locksmith if he does not have the keys. This is his leverage. If ex-gf has a job, she can get a loan, and if she does not have a job, how is she going to pay back your guy? How *has* she been paying back your guy?

Ewww.

He should make tracks from this situation post-haste, because legally, your guy is legally responsible for any damages caused by the ex's careless driving....and people with bad credit have more accidents than people with good credit scores. So the tracks should really be laid quickly.
