Bounced Checks

My job has been giving us bounced checks for the past 2 1/2 months. I finally got fed up and quit yesterday but I'm still owed a check and I'm affraid it's going to bounce also. What should I do?

You can report this to the dept of labor, or sue in Civil or District Court.

From you description, it appears that your employer is in violation of New York's Labor Law. The nonpayment of your wage or salary also constitutes a breach of contract. An attorney knowledgeable in this area will be able to help you navigate your contractual and statutory rights. Our office is prepared to contact the employer on your behalf and convincingly demand wage/salary payments; and, should that not result in a satisfactory solution, to file your claim in court. Your causes of action under the Labor Law should entitle you to significant damages in addition to the usual breach of contract damages. However, if your employer may be insolvent and out of funds, a negotiation of some sort of wage or salary payment plan might be a bit of a better alternative to a lawsuit; but that is something that would have to be explored.
