Legal Question in Employment Law in New York

What Family and Medical Leave Act?

I went on maternity leave for exactly 12 weeks. I followed the company's rules to "check in" monthly, etc. However, when I returned, I was told my job was eliminated because the department was restructured. Of the six of us, the four men were found other jobs in the company. The two women - me on maternity and a black woman - were given 3 months severance packages. Neither of us have found employment. (P.S. I'm an unwed professional woman over 35)

Everyone says I'm entitled to another equivalent position within the company. Is this correct?

Re: What Family and Medical Leave Act?

Sounds like you're right to me.

Call a New York Lawyer.....

us, or anyone else who deals in Employment

Discrimination Law.

Do NOT file on your own at the EEOC or State

or City Division of Human Rights.....you need

proper legal help. The FMLA is not the only

statute which may bear on this.....
