Legal Question in Employment Law in New York

I was just recently released from incarceration for parole violation and discovered that my ex-boyfriend, who had stolen my unemployment card, filed for compensation during a week that I was in jail. I am now being charged with fraud and being penalized for 176 days because of this despite my explanation of the events. Is there anything I can do? Thank you.
