Legal Question in Employment Law in New York

At the time of my mother�s death in October 2007 (she died intestate and I am the administrator), her employer owed her backpay. Her employer agrees that it owes her and has been paying it back in monthly installments (it�s a small non-profit), however the amount has been in dispute (over $20,000 difference) since the month before she died. I�ve been in touch with individual board members to let them know my preference for coming to a resolution, so far to no avail. So I�ve prepared a demand letter.

The big question remains what the statute of limitations on any potential action may be. The employer is and my mother resided in Queens NY.

The non-profit employer board meets tonight, so if the limit is 2 years then this would be the last meeting at which they may vote before the 2-year anniversary of my mother�s death, in case that�s the time limitation.

The statute of limitations in your case has no relation to the time that the board meets. The statute of limitations begins to run from the date that they stop making payments or the last contact you made in an attempt to collect monies owed. Write your demand letter.
