Breaking a lease

Under what grounds can one disolve a lease in NYC without penalty, or what penalties apply?

Generally you can't. One situtation you can is when the conditions of the lease hold are so horrible as to make it impossible to satsify the purpose of the lease, this is the concept of constructive eviction.
