Legal Question in Landlord & Tenant Law in New York

Expansion of bedroom while still living there.

I rent a 2 bed apt. in NY. My lease ends in March and I won't be renewing. I pay the heat. The landlord wants to expand one of the bedrooms soon. He is planning on just putting up plastic. Can I be compensated for the heat loss and inconvenience and can I refuse to let him in my apt? What remedy do I have. (He does have a bldg. permit and I don't have anywhere to put the stuff from that bedroom.)

You may be compensated since you will be out of possession of one of the rooms that you rent.

Can you refuse to let him in your apartment? Yes, but you would be better off keeping this civil.

I would ask for compensation by calculating the square footage of the apartment and finding out the dollar amount per square foot. I would then calculate the square footage you are loosing from giving up possession of the second bedroom. The difference should be your new rent.
