Legal Question in Landlord & Tenant Law in New York

Lease agreement

Two weeks ago, I had a guy sign a 6 month lease and pay her security deposit (in New York) to move in on 10/1/08. Then Saturday, 9/27 she paid her first months rent. The next day, Sunday, 9/28 she left me a message that he had found another apartment.

I have 2 questions. The first, I am renting 3 rooms separately in one apartment. Is that legal. Secondly, am I legally entitled to keep his rent and deposit being that he signed a lease weeks ago and is now backing out for no reason due to my fault.

I told him that he should just take my room because the money was none refundable... Am I correct?

The answer is it depends. I do not know where in New York your apartments are located. And in order for me to answer whehter you are entitled to keep his rent, I have to figure out what your lease says.
