lease agreements & evictions

have lease expired on aug 1 2007

with landlord did not renew lease

have told landlord i am moving by nov 1st 2007 she said to either sign new lease or move out by oct 1st 2007 have never been late or missed a payment in term of lease(aug 1 2006 to july 31 2007 also including both months preceding lease expiring landlord excepted both rents also have one month security deposit paid to landlord please tell me my rights

You do not have to vacate until/unless your landlord goes to court to evict you.

You would have to be served and appear in court and you would ask the Judge to give you until November 1st.

Most likely if she goes to court it will not be until after October 1st (when you do not vacate)and you won't get into court for at least another 8-10 days (after service) bringing you to mid October at the earliest. The Judge will likely give you the extra 2 wks to vacate.
