Legal Question in Landlord & Tenant Law in New York

i rent an apartment in a home with 3 other apartments. we have a landlord who doesnt want to pay for garbage removal, so he comes and takes the garbage himself when he can get around to it. sometimes 1 a month! because of this i dispose of my own garbage because it piles up outside and causes us to have skunks. i also brought it to his attention that skunks were getting into our basement, and he has done nothing. 2 weeks ago a skunk entered the basement of the house and sprayed, causing the house to smell terribly. we had to vacate the home for a few days. i called the landlord and he said he wasnt able to do anything about it and wanted us to handle the situation, he said it was our responsibility not his!!!! i deducted $200 from the rent to buy cleaning products, and rent a steam cleaner, and 1 nights stay at a motel the 1st night it happened. he is now telling me i have to pay that $200, and he has served with me with an eviction notice because of this! it is now 2 wks later my apartment clothes and furniture still smell, and anything i have done has not worked. a proffessional needs to come in and take care of this especially the basement! can you tell me what i should i do? and what my rights are?

When you go to court tell about the skunk and how the landlord breached his warranty of habitability.
