Legal Question in Medical Malpractice in New York

Does this fall under negligance and failure to treat. Family member delveloped Neuropathey, oncolgoist kept blaming it on the chemo. One week husband was walking and the next could not. Oncologist said she consulted with intern residents about tumors that developed on spine and per oncologist he was still safe. She did not check his reflexes upon 2 visits in the same week. Social worker got an emergency appt with primary care dr next day and he directly sent him to ER. Neuro team evlatued, sent for emergency MRI wheeled into ER stat and then pulled out 20 minutes later. Condition deterioted and passed away a couple of months later. Is this a negliance case.
