Legal Question in Medical Malpractice in New York

c-section NO anesthesia almost died

I was 34 weeks pregnant, went to

hospital because of bleeding.

Placental abruption. Was told I had

to deliver that night. Stable for 2

hours (though bleeding heavily).

Baby started to code, rushed into

emergency c-section, no

anesthesiologist available. Had to

deliver with no anesthesia to save

baby. Developed DIC, lost 90% blood

volume, almost died. Agonizing

recovery in ICU. Baby was (is) fine.

Question: shouldn't they have called

in anesthesiologist on call when it

was obvious that I was critical and

had to deliver that night? The other

2 were with patients when I was

rushed in to deliver, but NOT when I

arrived at hospital or when diagnosed

with placental abruption (about 1.5

hours before delivery). I would

appreciate any light that could be

shed on this...thank you.
