Legal Question in Medical Malpractice in New York

Does developmenting capsular contracture constitute for a malpractice case?

I had breast augmentation surgery 4 months ago, and I have development what I think is capsular contrature in my right one. It is very hard, sometimes painful, and does not move. Do I have a valid malpractice suit against my doctor? I have to have them redone? Please help.
