Legal Question in Medical Malpractice in New York

I went to the ER with an ear ache. the DR said I had a outer ear infection and perscribe what he told me were antibiotic ear drops. i used as directed but did not get better but got worse. I saw my regular doctor, she said it was a bad inner ear infection and put me on a course of oral antibiotics for 10 days. at 10days i still did not feel well so i went back to the ER. they said it was still infected and perscribe me antibiotic eardrops once again but come to find out at this visit i was told the first ER doctor did not give me antibiotoic eardrops but steriod eardrops and said that is why it progressed to such a bad ear infection. now over a month later my ear still does not feel right and after seeing my normal doctor yesterday she says i have a ruptured eardrum that is very bad and that i need to see an ENT. i have noticed hearing loss in that ear but i thought it was still infected, but it is not. do you think i have a case against the first ER doctor who told me he was giving me antibiotics but infact gave me steriods? thank

Advise treating with the ENT for a time to see whether the condition resolves. If not, a medical malpractice claim is worth exploring. In the meantime, get a complete copy of your hospital chart and hold on to it. Best, M. E. Zuller
