Legal Question in Medical Malpractice in New York

Facial Laser Surgery

Had a lower face lift with laser surgery two months ago. Was told I'd look 10 years younger. Lower face (neck) has already started to sag. The under eye area is incredibly wrinkled and I look older now than when I went in. Dr. not returning my calls. What are my chances of a suit?

Need more facts to say. Do you have before and after photos of yourself? Are you seeing a differnt doctor now? If so, what does he or she say about your procedure. Before filing a medical malpractice case in NY a doctor must certify there has been malpractice. Feel free to contact me as I have had good results for prior lawguru clients.

Almost no chance. These cases are very hard to litigate and are very subjective. Only if your injuries are really bad and you are gruesomely disfigured would an attorney take your case. Moreover, juries are unsympathetic to people who undergo elective surgeries.

As with most medical malpractice claims, the question is whether you have a bad result or the product of malpractice. The answer comes from another plastic surgeon after he's studied your medical records and performed an examination. It will be costly to find out whether you have a case. Good luck. Best, M. E.
