Legal Question in Medical Malpractice in New York

Hepatitis contracted from Hospital

Is it malpractice when you go into the Hospital for surgury and disclose all drugs that you have had a reaction to in the past, but are still given a drug that causes you to contract non-infectious Hepatitis? I am told that the chances of having this happen are a million to one. The name of the drug is Isoflorine. It is supposed to be an antistetic. It was disclosed that antistetics had caused a reaction in the past. I have more information if needed to get an answer. Thanks

As a practical matter, without even addressing the details, unless the injury that your sustained is extreme or substantial, the nature of medical malpractical litigation is such that no attorney will take a case.
