Hospital made error

I was in the hospital for 2 months when i was pregnant diagnosed with placenta previa. i had to have a total of 7 blood transfusions because when I had cesearan the dr cut a main artert and the blood was shooting up like a geyser(that is what the neonatal director said. I almost died. I havent still been able to recover because this happened in 2002 and its 2008 everytime I go to Dr they say I need blood transfusion.I have female problems. Has the statue of limitations expired

The statute of limitations may have expired. Generally, it is 2 1/2 years from the date the malpractice occurred. However, that time period could be tolled if you received continuous treatment (the transfusions may or may not qualify) for the same condition - in this case the cut artery. Yes the statute of limitations has expired it is usually 2 1/2 years for medical malpractice in the State of New York.
