Legal Question in Medical Malpractice in New York

Medical Malpractice on STD

Can I sue my doctor (dermatologist) of the clinic for not informing me about the test results? I want to him because I had what appeared to be genital warts. He did a biopsy and told me they would call me if there was anything to worry about and nobody called me. After about 2 months I went to another dermatologist and he said he was sure I had HPV which is an STD, I went to my old doctors office and got my test result from his assistant. The report said I had HPV. My new doctor has been treating me since past 7 weeks. I'm really mad at my doctor that he didn't inform me while it was at the beginning stage. Until I went to the new doctor the amount of warts multiplied by at least 5 times.

Re: Medical Malpractice on STD

You may have a case but the issue is whether or not the treatment would have been any different had you been told right away. The other issue is whether the case has enough monetary value to warrant the costs that go into a medical malpractice case. The statute of limitations is 2 & 1/2 years for medical malpractice assuming its a private doctor. The above is for informational purposes only and not meant as legal advise as there there is no attorney-client relationship.
