Legal Question in Medical Malpractice in New York

medical negligence and Lab errors

My mother was recently hospitalized in June 2008. The lab results would indicate that there was a blockage of the intestines. The lab report gave a error in one of her tests. Which we have proof. Because of this the treatment that was given to her could of caused bowel death. She passed away 9 weeks later of a bowel infarction. What do I need to hold the lab responsible for their error, and the doctor negligent for not performing the proper test?

Re: medical negligence and Lab errors

Intestinal blockages are typically discovered via C-T scans, not lab tests. Best thing is to obtain a complete copy of the hospital chart and bring it to a medmal attorney for review. If it appears the case has potential the attorney will likely want the chart reviewed by a physician, preferably a gastroenterologist. Good luck. Best, M. E. Zuller
