Legal Question in Medical Malpractice in New York

Is it negligent when a hospitalized patient with dementia is discovered to have de-solved pills in both ears?

Is it also negligent when the same patient, during his hospitalization, does not eat or drink for five or more days at a time, and when the doctor is questioned, he states that there is nothing that can be done unless the situation gets to the point where the patient gets very ill due to him not eating or drinking.
