Legal Question in Medical Malpractice in New York

Stroke

I am a 37yo mother of five. My mother died of stroke at age 49 and my father died of heart attack at 56. My doctor is aware of my family history but I had a complete checkup a few years ago (blood pressure, cholesterol,etc.) and passed with flying colors. I gave birth to my daughter feb.27. March 7, I went to doctor complaining of headaches, sore throat, and seeing stars in my eyes. I asked if the stars were migraines, and he said I wasn't having migraines. He took a throat culture which was negative, and brushed it off as hormones because I had a baby. 2 days later I suffered a massive stroke resulting in right paralysis and aphasia. Can I sue?

Hard to tell from the limited facts....in a medical malractice matter, your entire medical history is at issue, together with your current doctor's assessment and what he knew or should have known...this is too difficult to answer in a bulletin board forum.

Additionally, medical malpractice cases are never easy to assess without an expert (which is needed for a lawsuit to commence).
