Legal Question in Personal Injury in New York

Car accident/limited liability coverage of ''at-fault'' driver

We were seriously injured in a car accident in which other driver was totally at fault. Other driver only has $100,000 liability coverage per injury; we only have $50,000 SUM coverage so this won't help us in this case. Our injuries are substantial/permanent and are worth more than other driver's liability coverage provides for. In a personal injury lawsuit, can this other driver's homeowner's policy be ''tapped'' into as additional source of monetary recovery for us?

Regrettably, it cannot be "tapped" You are bound by the limits of the auto policy.
