Legal Question in Personal Injury in New York
Car Wash
Accident happened 2 years ago, an employee was behind the wheel taking the car off the track as it exit the end of the car wash, instead of hitting the break he excelerated the gas in which the driver of the truck infront of my vechile was inspecting his got pinned between both trucks broke his leg and now I'm getting sued above my insurance companys limit. I met with the leasing company today and was advised I can be sued for personal assets, house, property, so forth. I was told that the car wash since has change names so where does this leave me?? I wasn't in the car, for that 5 minutes it was in the hands of the car wash. PLEASE HELP ME!!!

Retain outside counsel to oversee the insurance company and protect your interests. I do this all the time. Good luck.

The insurance company still has a duty to hire lawyers to represent you and attempt to settle the action within the policy limits. You have the right to hire your own attorney if you feel that the company is not doing what it should.

Just because the lawsuit requests assets above the policy limits does not mean that the matter may not eventually be resolved within the policy limits. Let the insurance company take the lead, if you believe there is truly is a reasonable likelihood that the damages warrant personal exposure you have the option to hire an attorney separate from your insurance company.
