Legal Question in Personal Injury in New York

Do I have a case for defamation/slander?
My ex sister in-law is trying to find ways not to let my
brother see his daughter and has now said that she will file charges against my husband for sexual abuse. This
was previously mentioned in the divorce papers and I didn�t do anything at that time because I thought
nothing would come of it and I didn't want my husband to know she was saying these things. Just yesterday she said that
she is going to follow through. She has coached my 3 year old niece to say this happened. I know for a fact it never did. Should I file a suit or wait until she actually goes to court?

Court papers and official reports are privileged and can not be the besis for such an action. A false telephone call to CPS can.
