Legal Question in Personal Injury in New York

Determining Insurance Company's Undisclosed Money Sources to Arrive at a Fair Se

I was hit by a car and required a 3 Hour surgery for a fractured ankle and 8 months of recovery. The motorist's PIP limit is $50,000 and his no-fault provision is, also $50,000. Pain and suffering was assessed at, approximately, $200,000 to $300,000. The medical specials was $10,000. Can I sue for $90,000 (PIP limit plus remainder of No-Fault provision)? How can I determine what other sources of money the isurance company may not be disclosing so I may receive a fair settlement? I'm trying to settle without an attorney.

Good Day

PIP is No-Fault. When you sue, you are looking to the liability insurance coverage which, at the least, is $25,000.00 per person/$50,000.00,per occurrence by statute. It may also be the most.

You can sue for any amount regardless of the coverage.

Time limits apply for certain claims. See an attorney for these.
