Legal Question in Personal Injury in New York

Statute of limitations on automobile injuries

I was in a small fender bender 3 1/2 yrs ago when I was pregnant. There was some minor damage to my car that my auto insurance paid out. I went to my ob/gyn to make sure the baby was okay, but didnt go to the er. Now I just found out that I have some sort of whiplash that I have had for years per my doctor and I need chiropractic care, my insurance only covers partial payment. Would I be able to get payment from my auto ''pip'' even if the accident occured that long ago? I just found out about this injury recently.

I received your post on 11-6-2001.

For a lawsuit, the statute of limitations is 3 years.

For PIP benefits notcie must be given within 90 days.
