Hurt on the Job at Factory

my question is if a 17 year old was working in a factory and was hurt the hospital did surgery on him and no parent was notified the factory advised the child to settle out of court with no notice to his parent and he accepted they didnt tell him that he needed an attorney does he have a case.

Something is not right here. If he or she got hurt working for a factory then there should be Worker's Compensation protection. It is not clear what you mean by "settle." I think an attorney should be consulted to examine any settlement papers.

I am very surprised that any sane company

or individual "settled" with a minor.

Until age 19, all contracts of a minor may

be disaffirmed. Hence, the settlement

contract may be set aside. Further, any

negligence action or workers compensation

award, etc., if for an individual under

the age of 18, must be reviewed and

approved by a Court, normally the New

York State Supreme Court.

Thus, your son, if dissatisfied, should

retain counsel for further review.
