I was injured in a car accident. Is there a time limit regarding when I must initiate a legal claim against the driver?

you have three years to file a lawsuit and 30 days from the date of the accident to file for your no-fault benefits.

However, if you were involved in an accident with a state or city agency e.g. police vehicle then different rules apply.

If you were injured, it is very important that you file a Notice of Intention to make a Claim along with an application for No-Fault benefits with the proper insurance carrier(s) or the MVAIC within 30 days to ensure that your medical bills are properly paid. In addition, you have three years to sue for property damage and/or for your conscious pain and suffering as a motor vehicle accident is a negligence action.
