Legal Question in Personal Injury in New York

Hello, I was involved in an auto accident where the other person was driving on the freeway and became disabled and was in the middle of the farthest right lane(merging soon) I was gaining speed to be able to merge. the vehicle in front of me looked like it was moving because she had no emergency flashers on or brake lights (found out she was in park) then after looking left to see if I could merge I noticed she was not moving so I hit my breaks and hit her... The lady driving the vehicle was not licensed to drive a motor vehicle and the accident was unavoidable and I was wondering what can be done.
