Legal Question in Personal Injury in New York

personal injury

my son (17) was assaulted 4-2 and has herniated disc to c3 and c4. was punched in the face. also has facial damage. the police crime unit has made no arrest as of yet and are trying to talk my son out of having him arrested (they say its his decision only since he is over 16) because of the repercussins he might have to face. ie, driving past my house, egging his car. IM OUTRAGED.

What does your child want to do?

Has your child received medical attention?

Do you know whether your child will have permanent injuries?

Have you spoken with the commanding officer of the precinct about the officers trying to discourage your child?

If you want the person who assaulted your son arrested insist that the police take a criminal complaint from your son. If there is a concern that there will be retaliation then it may be appropriate to seek an order of protection. Your son also may pursue a civil action against the person who assaulted him.
