Legal Question in Personal Injury in New York

Police officer injured when pedestrian runs red light!

I was driving through a steady green light E/B on Greene Ave. when Driver # 2 proceeded through a steady red light N/B on Marcy Ave. and slammed into the rear passenger side door of my vehicle.

There weren't any witnesses; however, after the accident, Driver # 2 called her friend on her cell phone. Her friend got to the scene of the accident before the police. Her friend lied and told the police that he saw the accident. I told the police that her friend just got to the scene and did not witness anything. Nonetheless, the police listed him as a witness on the Police Accident Report.

This is an easy one. The cell phone will have records about the call. The friend may be charged with perjury.

I would be happy to subpoena the cell phone records for you.

Re: Police officer injured when pedestrian runs red light!

What is your question? Are you a police officer? How badly were you hurt. If the friend really was not at the scene, it could be proved by getting the driver's cell phone records and showing the call to the friend. Why would you call a friend if he was already there?

He is an "alleged" witness. The officer is just getting information. As Eric Rothstein says the cell info can be obtained if needed.

That the wonen's friend came to the scen first is not determinitive. That she is the woman's friend can be evidence that she is not an independent witness.
