Legal Question in Personal Injury in New York

Range of Award for herneated back disk from auto accident

I would like to know what the usual range of award is when one incurs a mild herneated disk as the result of one's car getting hit by another car. I am retired and havemedical coverage, so there is no loss of earnings, and no considerable medical bills, but there is pain and suffering. This prevents me from obtaining meaningful employment. What is the range of court judgement or settlements? The disk herneation is provable as I had an MRI before and after the accident.

Re: Range of Award for herneated back disk from auto accident

Although I do trial work in personal injury, the limited injury description makes it difficult to ascertain. Further, the type and location of the herniation, anterior or posterior, focal or not, thecal sac impingment, all have relevance.

And this only matters after a determination of the liability aspects.

Also, no-fault should be paying the medicals...not your private health care...as it should be denying benefits as no-fault is primary to it.

Additionally, the venue where the case will be brought also has a determinitive impact on the award range. There is a noticable difference in awards between, say, Kings County and Putnam County.

Any further questions, please inquire.
