Legal Question in Real Estate Law in New York

commercial vs. residential property sale

Is it legal to sell a commercial property as a residential property? Seller and attorney made false statements on contract of sale. Did not list all buildings or business on property. We were not allowed to inspect these buildings. This has now caused foreclosure and sale of our property, business and loss of our employment. We tried for a home equity loan and were told it was a commercial property by the bank 3 months after the sale. We beleive the attorney's are responsible. Also, we were not notified of the sale of our property. We had no way to defend ourselves. We are now facing eviction as well as our tenants who were never notified at all of any actions. Please Help!

If false statements were made that were also falsely verified you may very well have an action in contractual fraud as well as malpractice...this area of law does happen to be one of our specialties, however, we would need some more information before making a complete and proper determination.
