Legal Question in Real Estate Law in New York

eviction

I just got a summons to appear in court on June 1 for eviction for non-payment. I have arrangements to move into a new place at the end of June. I have contacted the landlords management company to try to set up payment and they refused. I am 7 months pregnant and have a 7 yr old son. Is it possible to get the judge to let us stay until the end of the month when we will be leaving anyway? There is no way for us to get in the new place or come up with full payment by the first.

Make sure you bring to court proof that you have a new place at end of month. The lease or letter from new landlord. The Judge prob will order an eviction but "stay" it until June 1st. That means that you will be allowed to stay until June 1st but after that the marshall will evict you.

If you can convince the Judge that you will be able to make all required payments before you leave, you will probably be given the time.
