Legal Question in Real Estate Law in New York

illegal subletter

i am the illegal subletter in a mixed use loft in bushwick. this is common practice in the building and city wide. there is a dispute of over money owed, however, i have receipt of payment, and have not done anything unjustly toward the leaseholder acting as landlord. she retains a profit off the apt and does not reside in the apt.

can i claim rights as 'tenant' if she is acting as 'landlord'?
