In NY, a tree from another property fell in my yard and caused damage to my fence. who is responsible for removal of the fence and clearing?

You are. If you can prove that the neighbor did something to the tree that accelerated its decay, you have a chance. But it's a long shot. Your insurance should contribute, perhaps a little toward the repair or the fence. I know this doesn't seem right, but a landowner is not required to keep trees in repair unless he first does something to make the repairs and maintenance necessary.
