Painting (a picture of) a house.

Hi,

An artist wants to paint a picture of a house. She is across the street, on public property, but the owner doesn't want her to paint a picrure of the house. (The artist has no intention of selling or publishing the painting. but does this matter?)

Does the artist need permission to paint the picture? If she wanted to sell the picture, would she need permission to sell it.

The artists is not prohibited from painting a picture anymore than a poet would be prohibited from writing about the house. The finished product is the property of the artists unless it was produced on commission.
