Legal Question in Real Estate Law in New York

I puchased a house in dutchess county, ny. The town required that all house sold have well water tested. I asked for a copy of the watwr report and was told by the sellers lawer if there was a problem with the well the bank wouldnot allow you close on the house. Come to find out that our well water was tested by the seller and it was determined by a lab the water does not meet acceptable drinking standards. I was not informed of this and found after reading an article in a localmagazine about poluted water in our town. The seller signed a property condition statement saying there were no known problems with the well. Can I sue him for fraud and are the title company and bank liable as they shouldhave been aware of this.
