Legal Question in Real Estate Law in New York

My father and mother left a home to 4 children and one neice. One daughter did not want to sell so we had to go to a lawyer and create an auction sale (Partition sale I think its called) and the case has been poorly handled for more then 2 years! It is just crimanal. Any way my sister, the one that didn't want to sell the house has not corresponded to my lawyer or anyone else for that long time (2 years). My question is this since this patition for sale was created because of her and since she is not responing (she lives in San Francisco) in anyway can I proceed with a regular sale without going to auction? Going to auction would mean more time, exposing the house to investors wanting a big discount, and just more aggravation. I have some interested in the property now and offering a good price. Can I just go through regular proceedures and skip the auctiion since there is no response from my sister?
