Legal Question in Real Estate Law in New York

Seller's disclosure required if home is Estate?

Is a seller's disclosure required if the home is ''The Estate of...''? There is a person living in the home (I believe the husband), but the home is being sold by the executor (a child).

Your description is unclear and/or incomplete and doesn't make sense. If you are asking whether the seller needs to identify itself, the answer is yes. The principle of "caveat emptor" does not license a purported seller to engage in fraud. Please repost or call me directly at 212-367-9167 to clarify the issue for more helpful advice.

Yes, however, I am sure his disclosure would be limited since he does not live in the house.
