(New York) Is it legal to withhold the proceeds from a property foreclosure sale on stipulation that the claimant refrain from pursuing any future litigation regarding the case? Thanks!

This is smelly. The legal/illegal split is not the key; but do not sign a stipulation waiving rights: it might be enforceable.
