Liability In a vehicle accident

My friend was in a car accident over a year ago. She had her permit and the driver had his license and was over the age of 18. She was driving and he was the passenger. She crashed it and told him that she would pay the deductible for the damage. He never claimed the accident to his insurance and now expects her to pay for the damage and the attorney fees that he plans to accumulate by taking her to court for the price of the damage. Is she liable for the damage? And can she counter sue him for her attorney fees?

If she had permission to drive as it appears, then his insurance company will cover the damages as New York State is a No-fault Insurance State.
