Received speeding ticket 10/28/03, hearing date is 4/26/2004 does the length of time between the alleged violation and the hearing date constitute a violation to my rights to due process, IE the right to a ''speedy'' trial

The answer depends upon where the ticket was issued and in general the answer is no there are no speedy trial dismissals,in your case even if there were they do not begin until you appear and are arraigned on the charge. On your appearance date/trial date if the officer is not prepared there may be the possibility of a dismissal on legal grounds. No, you do not have Speedy Trial rights to a Traffic Violation. Speedy trial issues arise for Misdemeanor & Felony criminal charges.
