Legal Question in Wills and Trusts in New York

uncles estate

my uncle died leaving 20% to my grandmother who is also deceased-what happens to her share? does it go to family members mentioned in the will or does it get shared by all who are in the will?

Re: uncles estate

I do agree with Mr. LeVine's answer.

A lawyer would have to take a look at the will to see how it reads.

Re: uncles estate

The answer will depend upon the language of the Will. Traditionally, if someone named in a Will predeceases the maker of the Will, language in the Will provides that the heirs of the person who predeceased take what he/she would have received. However, this is not always the case, and the alternative is that the Will could provide that if someone predeceases the maker, other named persons take what he/she might have received. I would need to see the Will itself to more accurately respond.
