Legal Question in Wills and Trusts in New York

our mother died on Oct.18,06. me and one of my kids over heard talk of a will.now my sister is being very secertive, she said there is nothing there. before we used to call each other on the way to work,now the calls have stopped to once a week.last week we were at her house the phone rang and she went to talk in the room, as we were leaving, i went to hug her good by she pushed me out the room door. and she was still on the phone talking very low, and hush hush i just want to know if it is any way i can get a copy of the will,to see if she left anything to my kids and grandkids. my sister is trying to keep everything for herself,my mother did that to us when my father died and we got nothing i don't want this to happen again

If your mother had no surviving spouse and no will, her children would divide the estate.

Your Mom passed just 16 days ago and already your family is dividing?

As a child, you are entitled to see a copy of the will once it is submitted for probate. If no will is submitted, you can assume there wasn't one and you/someone should petition to be appointed admistrator of her Estate.

That is of course assuming there is an Estate. Property, money, cars, something left in Mom's name alone.
