Legal Question in Credit and Debt Law in North Carolina

My mom needs help figuring out what kind of lawyer to go to for help. She has a contract dispute with T Mobile and we filed a review request with their customer review department and never heard anything back from them, then today we recieve a call from a collections company for a final payment on an account that was supposed to have been closed 5 years ago. When she cancelled the account 5 years ago she was moving out of country and had her bills forwarded to her son's address so he could take care of her bills. When she finally moved back and took back control of her bills she discovered that the contract had never cancelled and that he had been paying them for the past five years. When we tried to get her phone records from the cancellation month they told us that they only kept the account info for the past 4 years and that she would have to request a customer review to get the years previous, and when we did that they also told us that they only kept records for 4 years. Something doesn't sound right and we are now ready to hire a lawyer and are unsure of which kind to hire to help us. Please help! ~ NC

If this is in collections, the debt needs to be disputed. If your mother left the country, the statute of limitations is "tolled". I really cannot discuss any of the other specifics of your mother's case with you absent a power of attorney.

I can help for a reasonable fee. Have your mother contact me at [email protected].

If your mother's son voluntarily paid the bill and he had the authority to manage her affairs, I don't think she can get that 5 years' worth of money back.

I assume she cancelled it again after she moved back home, and they are trying to collect the remaining balance. A debt collection defense attorney is who your mother needs to talk to. She needs to provide evidence of all of the disputing she made after she got back and all bills, collection letters, etcetera.
