Purchase furniture from a store going out of business

Purchased furniture with amex card

from a furniture that is going out of

business. They can't tell us if we will

receive the furniture or will receive a

refund.

sounds like Levitz. these situations are always messy. i could not tell you what is going to happen. personally, i stopped buying from Levitz when they told me 6 weeks for a desk, and would not let me buy the floor sample.

if you want to cancel, have you tried asking Amex to cancel the transaction? if they have not delivered the furniture in a reasonable time, then they have breached their agreement to sell to you. that would be a reason to cancel the Amex charge. probably too late to do that, i suspect.

there is a whole legal procedure when a business goes into bankruptcy but stays in business. you do have legal rights, but i really could not assist.

i can not give you further advice. Maybe you could keep stopping by the store and asking what the status is, once a week or so.

Lousy situation.
