Legal Question in Criminal Law in North Carolina

drug testing

I recently was charged with possession and I am going to get first offender. I was wondering do they drug test first offenders and, if so if you fail you're first one do they take you're failure results and then at the next drug test use them to see if you've been smoking, or if you fail you're first one do they charge you. The reason I ask is because I smoked a lot of marijuana before I was busted and I don't think I've had enough time to clean up.

thanks.

Re: drug testing

In Virginia where I practice the Judge will ask you in Court whether you will pass a drug test. My advice is to be honest and say no, it hasn't been enough time to clean out (28 days). As long as you're honest, they will test you that day so that when they retest you they can see whether the THC levels have reduced.

In this case honesty is the best policy.

Good luck.
