Legal Question in DUI Law in North Carolina

DWI w/Failure to Appear -- License Revoked

I got pulled over in another county in NC 4 years ago, and got a DWI blowing a .11 at the police station. My license, of course, was taken on the spot. I never got my license back or even tried after the 30 days.

I never went to court and I am sure there is a warrant out for my arrest in that county. I plan on taking care of this very soon.

I read that it is a mandatory revocation of your drivers license for a year for a conviction of DWI.

Since I have not driven in four years and I am assuming that they have record that I never picked up my license, will the four years apply to the one year and I can be eligible for immediate restoration of my drivers license?

Since this is an FTA, too, probably not. You may have to wait the full year after you go to court. I would have my attorney have the FTA stricken and then argue that the year revocation began when your license was first taken. You don't get anything unless you ask. I would get an attorney to do this.
