Legal Question in Family Law in North Carolina

Adoption

I have been divorced for 5 years. We had 1 child together. I married my new husband almost a year ago. My husband has raised my child since he was 1. His REAL father has never paid child support or even been involved in my childs life. How do I dissolve real fathers rights so current husband can Adopt him?? Real father Would Probably sign papers Without going to court. Is that possible? Thank you for your help.

Re: Adoption

You are talking about Terminating the biolgical fathers rights. You also might be interested in having your present husband adopt the child. The biological father could sign a consent form for adoption, and the stepdad could then adopt. This IS, however a court procedure, although in some districts, the parties do NOT have to appear in court, and the matter is handled through the clerk's office. A step parent adoption varies in price, but is often available for $500. If the biological father objects, you will have to terminate his rights. That is a court action and could cost from $500 and up depending where you live and also, and more importantly, depending on whether or not the bioloical father fights the termination. Good Luck
